Content

Contract parties may agree between themselves not only on how to select the terms of their agreement, but also for resolving disputes that may arise in connection with the contract to which they are parties. The first word that comes to mind in such a case is the word "court", but the thought of choosing other routes comes to mind as an alternative. These entities may also agree on entrusting their arbitrators chosen or elected in the manner determined by them, to resolve disputes that may arise or have arisen between them. But despite the differences in the selected procedure, the court’s one or the arbitration’s, the finalization of each process goes into the decision-making process, which is binding on the parties in the dispute. Although the parties intended to avoid court in resolving their dispute, they cannot completely avoid it, because in many stages of the arbitration process, the court’s intervention is required with its decisions. Exactly the ratio between the role of the usual court on one hand and the arbitration court on the other hand is the axis of the scientific topic that will be presented at the scientific conference.
